1、 What is a 'special item'?
Answer: Order No. 243 of the General Administration of Customs on the Administration of Health Quarantine for Entry Exit Special Items specifies that special items include microorganisms, human tissues, biological products, blood and their products. There are a total of 4 categories, 43 subcategories, 58 commodity codes, and 165 inspection and quarantine codes.
Microorganisms: including viruses, bacteria, fungi, actinomycetes, rickettsia, spirochetes, chlamydia, mycoplasma, and other medical microbial strains (viruses) and samples, as well as parasitic and environmentally friendly microbial agents;
Human tissue: including human cells, cell lines, embryos, organs, tissues, bone marrow, secretions, excreta, etc;
Biological products: including vaccines, antitoxins, diagnostic reagents, cytokines, enzymes and their preparations used in the fields of human medicine and life sciences, as well as biologically active agents such as toxins, antigens, antibodies, antigen-antibody complexes, allergens, nucleic acids, immune modulators, microbiota preparations, etc;
Blood and its products: including human whole blood, plasma components, special blood components, and various human plasma protein products.
These types of goods have the characteristics of being prone to spreading infectious diseases, or having potential risks of spreading infectious diseases, cold chain transportation, and high requirements for customs clearance speed. They are subject to strict customs quarantine supervision and are not allowed to leave the country without permission.
Customs categorize special items for entry and exit into different risk levels based on the risk of possible transmission of human diseases, and adopt different methods of health quarantine supervision.
The customs categorizes special items into four levels: A, B, C, and D based on risk factors such as their pathogenicity, pathogenic pathways, usage, and controllability. Level A has the highest risk and Level D has the lowest risk.
The approval form for Class A special items is valid for one use and cannot be written off in batches, with a validity period of 3 months; B. The approval forms for Class C and D special items can be verified in batches, with a validity period of 6 months for Class B special item approval forms and 1 year for Class C and D special item approval forms; A. B-level special items must undergo subsequent supervision; The quarantine approval of Class D special items can authorize branch offices to carry out administrative licensing approval.
2、 Is it only necessary to apply for special item approval for goods in the "Corresponding Table of Customs Commodity Numbers and Inspection and Quarantine Names for Special Items"?
Answer: No, it's not right. Special items that belong to the category of entry and exit special items should be approved for special items.
According to the Announcement No. 46 of the General Administration of Customs in 2020 (on the Announcement of Releasing the Corresponding Table of Customs Commodity Numbers and Inspection and Quarantine Names for Special Items) implemented on April 1, 2020, "Entry and exit special items that are not included in the corresponding table shall be classified and declared according to the classification principle, And Article 11 of the Implementation Rules of the Frontier Health and Quarantine Law of the People's Republic of China stipulates that "carriers, consignors, or postal carriers of special items entering or leaving the country must declare to the health and quarantine organ and undergo health quarantine, and complete customs clearance procedures with the special item approval form issued by the health and quarantine organ. Without permission from the health and quarantine organ, entry or exit is not allowed, The entry and exit of special items must undergo health quarantine approval procedures.
