Introduction to Part 1 Stone

definition

Stone refers to materials made from natural rock as the main raw material and used for construction, decoration, stone tablets, handicrafts, or road surfaces, including natural stone and artificial stone.

Natural stone refers to materials processed from natural rocks, mainly including granite, marble, sandstone, and slate.

Artificial stone refers to a stone material made from natural stone as raw material and bonded with adhesive. It is widely used in fields such as building decoration, artistic processing, and furniture applications due to its uniform color, environmental protection, and energy conservation characteristics.

Stone can be divided into marble, granite, sandstone, slate, etc. according to its material, and into building stone and decorative stone according to its purpose.

Marble is a kind of metamorphic rock, which is mainly divided into carbonate rock marble (common beige and jade), serpentine rock marble (India's big flower green, etc.) and dolomite marble (Spain's deep coffee net and Türkiye's light coffee net and gold coffee).

PART 2 Customs Clearance Process

Imported stone enterprises need to prepare all necessary materials such as purchase contracts, invoices, packing lists, bills of lading, official certificates of origin of the exporting country (non essential), and master the product name, English name, color, specifications, dimensions, weight, mining area name, and other information of the imported stone for declaration.

According to the import enterprise's own situation, a customs declaration company can be entrusted to handle the customs declaration process and sign relevant commission contracts and certificates.

Before transportation, import enterprises need to confirm with the cargo owner whether the dock port has unloading conditions.

Some import enterprises may believe that after entrusting a customs declaration company to handle the customs declaration procedures, they can stay out of it. But this is a misunderstanding, it is important to clarify the declaration responsibility. According to the relevant provisions of Articles 9 and 10 of the Customs Law:

Consignor of import and export goods:

If a customs declaration enterprise is entrusted to handle the customs declaration procedures, it shall provide the true information of the entrusted customs declaration matters to the customs declaration enterprise.

Customs declaration enterprise:

Those who accept the commission of the consignee or consignor of import and export customs declaration goods to handle customs declaration procedures in their own name shall bear the same legal responsibility as the consignee or consignor, and shall conduct a reasonable review of the authenticity of the information provided by the consignor.

Imported stone enterprises and customs declaration companies need to understand the applicable tariff rates for the goods. According to the "Import and Export Tariff Comparison User Manual (2022)", three of the main four digit tax codes for imported stone materials are subject to a tariff of 4% or less and a value-added tax of 13%; There are three that levy tariffs of 10-15% and value-added tax of 13%.

The accuracy of tax code columns is one of the most important foundations for accurate reporting of elements.

Customs stone inspection refers to the inspection and inspection carried out by customs officers one by one according to the instructions issued by the superior risk control department. Instructions include inspection methods, requirements, and proportions (quantity).

The inspection methods for imported stone materials include organic inspection and manual inspection, with manual inspection being the main method. The inspection requirements include verifying the declaration elements and quality of stone materials to determine whether the enterprise has truthfully declared and whether the goods certificate is consistent.

Granite may contain certain radioactive elements due to its unique formation characteristics, thus there is a possibility of excessive radioactivity. In accordance with relevant documents, the customs adopts a combination of on-site spot checks and laboratory nuclide analysis to inspect and supervise the radioactivity of imported granite.
