1、 Before entry

Article 10 of the Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China stipulates that those who import animals, animal products, plant seeds, seedlings, and other reproductive materials must submit an application in advance and complete the quarantine approval procedures.

Article 11 of the Implementation Regulations of the Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China stipulates that the quarantine approval procedures shall be completed before the signing of the trade contract or agreement; Article 12 stipulates that those who bring or mail plant seeds, seedlings, and other reproductive materials into the country must apply in advance and complete quarantine approval procedures.

01 Entry Concession Quarantine Approval

According to Article 5, Paragraph 3 of the Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine and Article 9 of the Implementation Regulations of the Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine, if it is necessary to introduce prohibited substances as stipulated in the first paragraph of this article due to special needs such as scientific research, an application must be submitted in advance and approved by the General Administration of Customs or its authorized direct customs.

Prohibited items include:

1. Pathogens of animals and plants (including strains, viruses, etc.), pests, and other harmful organisms;

2. Countries and regions where animal and plant epidemics are prevalent, as well as related animals and plants, animal and plant products, and other quarantine objects;

3. Animal carcasses;

4. Soil.

I. Application materials

Article 6 (5) of the "Measures for the Administration of Approval of Entry Animal and Plant Quarantine" stipulates that for special needs such as scientific research, those who introduce prohibited items listed in Article 5 (1) of the Entry and Exit Animal and Plant Quarantine Law must submit a written application, stating their quantity, purpose, introduction method, epidemic prevention measures after entry, scientific research project approval report, and relevant competent authorities' approval project approval documents.

The applicant should prepare the following materials:

1. Proof of legal personality of the applicant unit;

2. Written application (including the purpose, quantity, introduction method of the entry quarantine object, epidemic prevention conditions of the applying unit, epidemic prevention measures for the transportation, use, harmless treatment, and emergency response of the entry quarantine object, etc.);

3. Scientific research project initiation report and relevant approval documents from the competent department.

The relevant epidemic prevention conditions of the application unit must be confirmed by the local customs, and the applicant shall bear legal responsibility for the authenticity, legality, and effectiveness of the submitted materials.

II. Handling Procedures

The application unit submits the application for approval of quarantine licensing through the "Internet plus+Customs" online government service platform.

After accepting the application, the customs conducts an examination based on legal conditions and procedures, and makes a decision on whether to grant or not to grant the license.

III. Other matters

The imported plant quarantine items mentioned above should be sealed and packaged with materials that are not easily damaged.

Some special plant quarantine objects used for scientific research and exhibitions do not require quarantine approval, such as dried and inactivated plant and insect specimens; Ores and rocks without soil; Small batch botanical garden cultivation media, fertilizers, etc. for laboratory testing.

The customs directly under the jurisdiction of the General Administration of Customs shall approve certain imported plant quarantine objects, such as experimental model fruit flies and model nematodes, which shall be approved by the customs directly under the jurisdiction of the General Administration of Customs.

02 Approval of Imported Plant Reproductive Materials

According to Article 9, Paragraph 2 of the Implementation Regulations of the Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China, the quarantine approval of imported plant seeds, seedlings, and other reproductive materials shall be handled by the authorities specified in the Plant Quarantine Regulations.

Article 12 of the Regulations on Plant Quarantine stipulates that when seeds and seedlings are imported from abroad, the importing unit shall apply to the plant quarantine institution of the province, autonomous region, or municipality directly under the central government where they are located and complete the quarantine approval procedures.

Plant reproductive materials other than those prohibited by the Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China shall be approved by the agricultural and forestry departments. If importing Arabidopsis, apply for quarantine approval from the agricultural department.

2、 At the time of entry

Article 15 of the Law of the People's Republic of China on the Entry and Exit Quarantine of Animals and Plants stipulates that imported animals and plants, their products, and other quarantine objects that have passed quarantine inspection are allowed to enter the country.

01 Documents required for import declaration:

Import Animal and Plant Quarantine License, Import Forest Seed and Seedling Quarantine Approval Form, and Import Agricultural Seedling Quarantine Approval Form from Abroad. The above documents have been verified online, and there is no need to provide paper documents for customs declaration.

The official plant quarantine certificate issued by the exporting country or region. Imported Drosophila melanogaster and other experimental nematodes, as well as Arabidopsis, are exempt from providing plant quarantine certificates issued by the exporting country.

Other documents that should be obtained according to law shall be handled in accordance with relevant regulations.

02 Port Release

When the imported plant quarantine object arrives at the port, the port customs shall verify the cargo certificate and implement port quarantine. Only after passing the inspection can it be released.

3、 After entry

The customs shall implement subsequent quarantine supervision in accordance with relevant laws and regulations. Import units should strengthen their awareness of biosafety risks, strictly comply with national biosafety, import and export animal and plant quarantine laws, regulations, and rules, fulfill their main responsibilities, and actively cooperate with customs to implement follow-up supervision.
