(2) Unused but exceeding the warranty period (non warranty period);

 

(3) Unused but stored for a long time, resulting in significant tangible damage to the components;

 

(4) Mixed installation of new and old components;

 

(5) Refurbished;

 

 

 

2、 How to manage the import of used mechanical and electrical products?

 

 

 

According to the "Measures for the Administration of Import of Mechanical and Electrical Products" (Order No. 7 of 2008 by the Ministry of Commerce, the General Administration of Customs, and the General Administration of Quality Supervision, Inspection, and Quarantine, revised by Order No. 7 of 2018 by the Ministry of Commerce), the state implements classified management of the import of mechanical and electrical products, which are:

 

(1) Prohibition of Import

 

(II) Restriction of imports

 

(III) Free import

 

 

 

What are the prohibitions on importing used mechanical and electrical products?

 

 

 

According to Table 1 of the Management Measures for the Inspection and Supervision Measures of Imported Used Mechanical and Electrical Products (2014), the prohibited import of used mechanical and electrical products includes these four categories:

However, according to the Announcement No. 106 of 2018 by the Ministry of Commerce and the General Administration of Customs on the Adjustment of the Catalogue of Used Mechanical and Electrical Products Prohibited from Import, issued on December 29, 2018, "in case of any inconsistency between previous relevant provisions and this announcement, this announcement shall prevail. The" Catalogue of Prohibited Import Goods (Second Batch) "announced by the Ministry of Foreign Trade and Economic Cooperation, the General Administration of Customs, and the General Administration of Quality Supervision, Inspection, and Quarantine on December 27, 2001 shall be abolished simultaneously, The first category of prohibited import of used mechanical and electrical products in Table 1 of the "List of Inspection and Supervision Measures for Imported Used Mechanical and Electrical Products (2014)" has been adjusted to the Announcement No. 106 of 2018. （1） The Catalogue of Used Mechanical and Electrical Products Prohibited from Import (see Announcement No. 106 of 2018 of the Ministry of Commerce and the General Administration of Customs on the Adjustment of the Catalogue of Used Mechanical and Electrical Products Prohibited from Import for details).

 

（2） Old glass shells, old picture tubes, recycled picture tubes, old monitors, etc.

 

（3） Used mechanical and electrical products with industrial and commercial compressors using chlorofluorocarbons as refrigerants.

 

（4） Used household electrical products with chlorofluorocarbons as refrigerants and foaming agents, and used mechanical and electrical products with compressors using chlorofluorocarbons as refrigerants.

 

 

 

According to the "Measures for the Administration of Import of Mechanical and Electrical Products" (Order No. 7 of 2008 by the Ministry of Commerce, the General Administration of Customs, and the General Administration of Quality Supervision, Inspection, and Quarantine, as amended by Order No. 7 of 2018 by the Ministry of Commerce): "Old mechanical and electrical products listed in the" Catalogue of Goods Prohibited from Import "may enter the country for maintenance (including remanufacturing) and be re exported with the consent of the Ministry of Commerce, provided that they meet the conditions of environmental protection and safety production. What are the restrictions on importing used mechanical and electrical products?

 

 

 

According to the "Management Measures for the Import of Key Old Mechanical and Electrical Products" (Order No. 5 of 2008 by the Ministry of Commerce, the General Administration of Customs, and the General Administration of Quality Supervision, Inspection, and Quarantine, revised by Order No. 7 of 2018 by the Ministry of Commerce):

 

The old mechanical and electrical products that are restricted from import by the state are referred to as key old mechanical and electrical products.

 

The "Key Old Mechanical and Electrical Products Import Catalogue" is included in the "Import License Management Goods Catalogue", which is formulated, adjusted, and announced by the Ministry of Commerce in conjunction with the General Administration of Customs.

 

Implement import license management for old mechanical and electrical products listed in the "Catalogue of Goods Subject to Import License Management". Old mechanical and electrical products listed in the import catalog must apply to the Ministry of Commerce for an import license.

 

 

 

Key old mechanical and electrical products can only be imported after passing inspection and quarantine. The Maritime Safety Administration of the People's Republic of China and its entrusted institutions are responsible for inspecting imported old ships; The China Fishery Vessel Inspection Bureau is responsible for inspecting imported old fishing vessels; The Civil Aviation Administration of China is responsible for inspecting imported used aircraft. The customs is responsible for quarantine of all other imported key old mechanical and electrical products, and for inspection of key old mechanical and electrical products imported except for old ships and aircraft.

 

 

 

How to manage the free import of used mechanical and electrical products?

 

 

 

According to the Measures for the Administration of Import of Mechanical and Electrical Products:

Old mechanical and electrical products exempt from pre shipment inspection: According to the Decision of the State Council on Cancelling and Adjusting a Batch of Administrative Approval Items and Other Matters (Guo Fa [2014] No. 50), when importing old mechanical and electrical products under the following four circumstances, only supervision and management will be implemented, and no inspection will be conducted:

 

1. "Outbound maintenance and re import"

 

2. "Temporary export and re import"

 

3. "Export return and re import"

 

4. "Domestic transfer and re import"

 

The receiving unit shall declare to the customs with the "Exemption from Pre shipment Inspection Certificate for Imported Used Mechanical and Electrical Products" and the "Declaration of Special Import Conditions" and necessary materials.

 

 

 

 

What are the key regulatory points for customs inspection after arrival at the port?

 

 

 

Customs inspection of used mechanical and electrical products includes port inspection and destination inspection.

 

Port inspection: implemented by the port customs, the inspection documents are verified batch by batch.

 

Destination inspection: implemented by the destination customs, including

 

（1） Consistency verification;

 

（2） Safety project inspection;

 

（3） Inspection of hygiene and environmental protection projects;

 

（4） Verify the effectiveness of technical and corrective measures taken for non compliant items found during pre shipment inspections, and conduct inspections on items not covered by pre shipment inspections; Conduct spot checks on pre shipment inspection items that have been implemented when necessary;

 

（5） The inspection of other items shall be carried out in accordance with the relevant regulations for the inspection of similar mechanical and electrical products.

 

If the pre shipment inspection results of imported used mechanical and electrical products are inconsistent with the port inspection and destination inspection results, according to the "Measures for the Supervision and Administration of Imported Used Mechanical and Electrical Products Inspection", the port inspection and destination inspection results shall prevail.

5、 How to fill out the customs declaration form for used mechanical and electrical products?

 

 

 

The declaration of old mechanical and electrical products is more complex than the declaration of general mechanical and electrical products. According to the "Customs Declaration Form Filling Standards", old mechanical and electrical products should first be labeled with the word "old" or "second-hand" before the product name.

 

 

 

To meet the needs of customs tariff element review, corresponding elements such as "brand", "specification, model", "purpose", "function", etc. should be filled in accordance with the requirements of the "Catalogue of Customs Import and Export Commodity Norms of the People's Republic of China".

 

 

 

To meet the needs of customs price evaluation, in addition to filling in the requirements of the "Catalogue of Import and Export Commodity Standard Declaration", old mechanical and electrical products should also fill in the five elements of "reset price", "production year", "total usable life/frequency", "used life/frequency", and "newness rate".
