Announcement No. 41 of the General Administration of Customs in 2023
In order to accurately determine the origin of import and export goods under the "Arrangement between the Government of the People's Republic of China and the Government of the Republic of Nicaragua on Early Harvest of the Free Trade Agreement" and promote economic and trade exchanges between China and Nicaragua, The General Administration of Customs has formulated the "Measures of the Customs of the People's Republic of China on the Administration of the Origin of Import and Export Goods under the Arrangement between the Government of the People's Republic of China and the Government of the Republic of Nicaragua on the Early Harvest of Free Trade Agreements". It is hereby announced and will come into effect from May 1, 2023.
If the consignee or its agent of imported goods applies to enjoy the tax rate under the "Arrangement between the Government of the People's Republic of China and the Government of the Republic of Nicaragua on Early Harvest of Free Trade Agreement" when importing goods, The Customs Declaration Form for Import (Export) Goods of the People's Republic of China (hereinafter referred to as the "Declaration Form") should be filled out in accordance with the relevant requirements of Announcement No. 34 of 2021 of the General Administration of Customs on "preferential trade agreements for goods that have not yet achieved electronic information exchange of origin", and the certificate of origin should be submitted. When filling in the "Preferential Trade Agreement Benefits" column of the "Customs Declaration Form" commodity item, the "Preferential Trade Agreement Code" column should be filled with code "24".

Measures of the Customs of the People's Republic of China on the Administration of the Origin of Import and Export Goods under the Arrangement between the Government of the People's Republic of China and the Government of the Republic of Nicaragua on the Early Harvest of the Free Trade Agreement
Article 1: In order to accurately determine the origin of import and export goods under the "Arrangement between the Government of the People's Republic of China and the Government of the Republic of Nicaragua on Early Harvest of Free Trade Agreement" (hereinafter referred to as "Early Harvest") and promote economic and trade exchanges between China and Nicaragua, in accordance with the "Customs Law of the People's Republic of China" (hereinafter referred to as "Customs Law") These measures are formulated in accordance with the Regulations of the People's Republic of China on the Origin of Import and Export Goods and the Early Harvest.
Article 2: These measures are applicable to the origin management of import and export goods under the "Early Harvest" between China and Nicaragua.
Article 3: Goods that meet one of the following conditions are original goods under the "Early Harvest" category (hereinafter referred to as original goods) and possess the original qualification under the "Early Harvest" category (hereinafter referred to as original qualification):
(1) Completely obtained or produced in China or Nicaragua;
(2) Produced in China or Nicaragua using only raw materials that comply with the provisions of these Measures;
(3) Produced using non originating materials in China or Nicaragua:
1. Belonging to the scope of application of the "Product Specific Rules of Origin" (hereinafter referred to as the "Specific Rules", see Annex 1) and complying with the corresponding changes in tax classification or other provisions;
2. It does not fall within the scope of application of the Specific Rules, but the regional value component calculated using the formula listed in Article 5 of these Measures shall not be less than 40%;
When there are changes in the specific rules of origin for products under the "Early Harvest" category listed in the "Specific Rules", the General Administration of Customs shall make a separate announcement.
