About importing aquatic products

China is a major importer of aquatic products, with Russia, India, the United States, Ecuador, and Canada being the main sources of aquatic product imports. Customs clearance process for imported aquatic products

The Measures for the Administration of Import and Export Food Safety of the People's Republic of China (Order No. 249 of the General Administration of Customs) will be officially implemented on January 1, 2022.

The customs shall carry out conformity assessment on imported food in accordance with relevant laws and administrative regulations on import and export commodity inspection.

1、 Food Safety Assessment for Exporting Countries (Regions)

The General Administration of Customs can evaluate and review the food safety management system and food safety status of overseas countries (regions), and determine corresponding inspection and quarantine requirements based on the evaluation and review results.

2、 Registration of overseas production enterprises

The General Administration of Customs implements registration management for overseas production enterprises exporting food to China and publishes a list of registered enterprises.

You can log in to the website of the General Administration of Customs to search for "Important Information on the Supervision of Import and Export Aquatic Products" and "Registration Information of Overseas Production Enterprises of Imported Aquatic Products".

3、 Importer/exporter registration and registration number in China

1. Filing of Importers and Exporters

Overseas exporters or agents exporting food to China (hereinafter referred to as "overseas exporters or agents") shall file a record with the General Administration of Customs.

Food importers shall file a record with the customs of their place of residence.

Filing System for Importers and Exporters of Imported Food and Cosmetics at the General Administration of Customs（ http://ire.customs.gov.cn/ ）Fill in the true information and submit paper materials to the customs at the place of business registration.

2. Registration number in China

The food exported to China produced from January 1, 2022 shall have its registration number in China or a registration number approved by the competent authorities of the country (region) on the inner and outer packaging of the food exported to China. Registration number rules in China: "C"+3-digit English country code+4-digit digital product category code+6-digit year/year/date+4-digit sequential number. If relevant information is marked, consistency between declaration, actual goods, and certificate must be ensured. 4、 Approval of Entry Animal and Plant Quarantine

1. Approval scope

The customs shall implement quarantine approval management for imported food that requires quarantine approval for imported animals and plants in accordance with the law. Food importers should obtain import animal and plant quarantine permits before signing trade contracts or agreements.

The quarantine approval system is implemented for imported amphibians, reptiles, aquatic mammals, other farmed aquatic products, and Japanese imported aquatic products to China.

2. Fill in application information

Log in to the "Internet plus+Customs" platform（ http://online.customs.gov.cn/ ）Under the Import and Export Food module, select the corresponding category and fill in the relevant information.

3. Acceptance time limit

According to the review results, the customs shall issue a "Quarantine License" or a "Notice of Unapproved Quarantine License Application" within 20 days from the date of acceptance of the application by the preliminary review agency.

5、 Document review

When importing aquatic products, enterprises should provide relevant trade documents and inspection and quarantine certificates issued by the exporting country or region. The content and format of the official inspection and quarantine certificate for aquatic products exported to China by the exporting country (region) should be confirmed by the General Administration of Customs. For aquatic products listed in the quarantine approval catalog of imported aquatic products by the General Administration of Customs, a valid "Entry Animal and Plant Quarantine License of the People's Republic of China" should also be provided.

For deep-sea self catching aquatic products, proof materials such as the confirmation form of deep-sea fishery projects issued by the Ministry of Agriculture and the qualification certificate of deep-sea fishery enterprises issued by the Ministry of Agriculture are required.

6、 On site inspection

The customs shall conduct on-site inspections of imported food according to the needs of supervision and management.

The on-site inspection shall be carried out in accordance with Article 28 of the Measures for the Administration of Import and Export Food Safety of the People's Republic of China (Order No. 249 of the General Administration of Customs).

New regulations on cargo labeling

The packaging, labeling, and labeling of imported food should comply with Chinese laws and regulations and national food safety standards; If there should be a manual in accordance with the law, there should also be a Chinese manual.

For imported aquatic products, there should be strong, clear, and easily recognizable Chinese and English or Chinese language and export country (region) text markings on the inner and outer packaging, indicating the following contents:

Trade name and scientific name, specifications, production date, batch number, shelf life and storage conditions, registration number in China or registration number approved by the competent authority of the country (region) where the product is located, production method (seawater fishing, freshwater fishing, aquaculture), production area (marine fishing area, freshwater fishing country or region, country or region where the aquaculture product is located) The name, registration number and address (state/province/city) of all production and processing enterprises involved (including fishing vessels, processing vessels, transport vessels and independent refrigerators) must be marked with the destination of the People's Republic of China.

7、 Supervision and sampling inspection

The customs formulates annual national imported food safety supervision and inspection plans and special imported food safety supervision and inspection plans, and organizes their implementation.

Aquatic products and their products should comply with the general requirements of GB 2733-2015 "National Food Safety Standard for Fresh and Frozen Animal Aquatic Products". The specific requirements and standards are as follows:

8、 Conformity assessment of imported aquatic products

Imported aquatic products that have passed the customs qualification assessment are allowed to be imported.

If imported aquatic products fail to pass the customs conformity assessment, a certificate of non conformity shall be issued by the customs; If the safety, health, and environmental protection items are not up to standard, the customs shall notify the food importer in writing and order them to be destroyed or returned; If other projects are not qualified and meet the qualification evaluation requirements after technical treatment, they can only be imported. If the relevant imported aquatic products cannot complete technical treatment within the specified time or still fail to meet the standards after technical treatment, the customs shall order the aquatic product importer to destroy or return them.

9、 Inspection of import and sales records

According to the requirements of Article 21 and Article 22 of the Measures for the Administration of Import and Export Food Safety of the People's Republic of China (Order No. 249 of the General Administration of Customs), food importers shall establish a food import and sales record system and an audit system for overseas exporters and production enterprises.
